POLAND DIRECT RECRUITMENT
TERMS AND CONDITIONS FOR THE INTRODUCTION
OF PERMANENT STAFF

• Definitions
  
  In these Terms and Conditions the following definitions apply:
  • "PDR" means Poland Direct Recruitment;
    
  • "the Client" means the person, firm or company to whom the applicant is introduced;
    
  • "the Applicant" means the person introduced by PDR to the Client;
    
  • "Engagement" means the appointment of the Applicant to perform services for and on behalf of the Client whether under a contract of service or for services;
    
  • "the Fee" means the fee calculated in accordance with clause 3(b) of these Terms and Conditions.
• Terms and Conditions
  
  These Terms and Conditions are deemed to be accepted by the Client by an interview with the Applicant. No variation of the Terms and Conditions shall be valid unless approved in writing by a Director of Poland Direct.
• Notification and Fees
  
  • The Client shall notify PDR immediately on the Engagement of an Applicant and shall provide details to PDR of the gross annual salary and benefits payable to or received by the Applicant pursuant to the Engagement.
  • On Selection of the Staff by the Client, the Client shall pay to PDR an agreed fee by PayPal.
  • A one off payment will be requested after the initial agreement of the chosen candidate/s for permanent contracts.
  • As soon as one off payment is received, cadidates travel details and a date of arrival (usually 7-10 days) will be released.
  • Fee will be returned if the Engagement is terminated by either the Applicant or the Client in the first 2 weeks of engagement (an Administration fee may be charged). However, if a client arranges for staff to be brought over from another country and then the client changes their minds, the fee becomes non-refundable.
  • Where an Engagement does not exceed 12 weeks PDR shall give the following refund of the Fee:
    For Engagement Terminating during or at the end of:
    
    Week 1…………………………………..100% refund less €30 admin fee
    Week 2…………………………………….75% refund
    Week 3…………………………………….60% refund
    Week 4…………………………………….50% refund
    Week 5+6………………………………….40% refund
    Week 7+8………………………………….25% refund
    Week 9+12………………………………...15% refund
    
    Provided the Client notifies PDR in writing 7 days of the date of termination.
    
• Indirect Introductions
  
  The Client shall be liable to pay the Fee if it refers the Applicant to any of its subsidiaries or associated companies or to any third party, which engages the Applicant.
• Liability
  • Whilst PDR endeavours to ensure the suitability of the Applicant the Client shall take such steps as it deems necessary to satisfy itself as to the suitability of the Applicant
  • PDR shall not be liable for any loss, expense, injury to person, damage or delay suffered by the Client arising from or in any way connected with the introduction or Engagement of any Applicant or from the failure of PDR to introduce any Applicant.
• Disputes
  
  In the event of a dispute the parties hereto submit to the jurisdiction of the High Court of Justice in england or Ireland.
